Welcome to Pickleball Superhero. These Terms of Service ("Terms") govern your use of our websites, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

Beta Program & Confidentiality

Pickleball Superhero is currently in a limited beta program. By participating, you acknowledge that:

• The platform, its features, design, and functionality are confidential and proprietary to Pickleball Superhero.
• You agree not to share screenshots, recordings, or detailed descriptions of the platform with third parties, including competing services.
• Feedback you provide may be used to improve the platform without compensation or attribution.
• Beta features may change or be removed without notice.

This confidentiality obligation remains in effect until Pickleball Superhero publicly launches or notifies you otherwise.

User Accounts

• Upon creating an account, we will generate a user profile to enhance your experience. Refer to the Privacy Policy for detailed information on how we will utilize your data.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must provide accurate and complete information when creating your account and keep this information up to date.
• You must be at least 16 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Services.

Communications

• When you open an account, you consent to receive communications from us including newsletters, event reminders, partner notifications, and promotional offers via email, text message, or push notifications.
• Tournament-related communications (registration confirmations, schedule updates, partner invitations) are considered transactional and may be sent regardless of your marketing preferences.
• You can modify your communication preferences in your account settings at any time.

Tournament Registration

• Tournament registrations are subject to the specific rules, refund policies, and terms set by each tournament director.
• We collect information from your account and share it with tournament directors and event organizers to facilitate your registration and participation.
• You are responsible for reviewing and agreeing to any event-specific policies before completing registration.
• Partner invitations sent through our platform are your responsibility. Ensure you have consent before inviting someone to be your doubles partner.

Tournament Directors

If you use Pickleball Superhero as a tournament director:

• You are responsible for all players you register on behalf of and must have their consent to do so.
• You are responsible for setting and communicating your event's refund policy, rules, and any other terms to participants.
• You agree to handle participant data in accordance with applicable privacy laws and our Privacy Policy.
• You are responsible for the accuracy of all event information including dates, locations, fees, and format.

Payments

• All payments are processed through our third-party payment processor. By making a payment, you agree to their terms of service.
• Registration fees are set by tournament directors. Pickleball Superhero may charge a service fee which will be disclosed before checkout.
• Refund policies are determined by individual tournament directors. Please review the event's refund policy before registering.

Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Impersonate any person or entity or misrepresent your affiliation.
• Interfere with or disrupt the Services or servers or networks connected to the Services.
• Attempt to gain unauthorized access to any part of the Services or other users' accounts.
• Use automated means to access the Services without our permission.
• Harass, abuse, or harm other users.

Intellectual Property

The Services and all content, features, and functionality are owned by Pickleball Superhero and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.

Disclaimers

The Services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

Pickleball Superhero is a platform connecting players with tournament directors. We are not responsible for the conduct of tournament directors, the quality of events, or any disputes between users.

Limitation of Liability

To the maximum extent permitted by law, Pickleball Superhero shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by posting a notice on our website or sending you an email. Your continued use of the Services after changes become effective constitutes your acceptance of the new Terms.
